      Quite simply they are interested in the application to all past and current and future presidents. Trump is only the lesser immediate issue. If they judge incorrectly possibly no president will be able to act without fear of reprisal or litigation. Presidents order the death of people every day via military actions.

    If they wanted to "get it right", they should have refused to hear Trump's ridiculous appeal, and simply allowed the lower court's thorough, reasonabke and rational ruling stand. The subject matter of the apoeal could NOT be more absurd ... a sitting US POTUS being afforded absolute immunity to do "anything" and "everything" that he/she wants without any risk of accountability whatever? Really? What a horrible joke!

      150% agreed!!! Eliminate the imbecilic filibuster for it is of literally no use. However, instead of expanding scotus, we need to seriously limit the time anyone is allowed to serve, along with GREATLY increasing the bare minimum qualifications in order to even be nominated for the position. Mandatory 12 grades of completed education along with a minimum of 10 full years of active service as a judge just to begin with.
      The only ones who would "suffer" from such new rules would be those unqualified for the position in the first place.

      1. Decimating Voting Rights
      2. Decimating women's Rights
      3. Not protecting children or innocents via draconian pro-gun "rights"
      4. Not honoring Amendment 14, section 3 of the constitution (via the case brought by Colorado on protecting the nation by not putting Trump on the 2024 ballot)
      5. Citizens United = giving Big Money the legal right to purchase lawmakers
      6. Earlier court--with some of the same dimwitted players: giving the 2000 Presidency to Bush, Jr

      Exactly. The appeals court got it right. They refused the case and demanded the appeals court write an opinion, then they took the case anyway and slow walked it. Now they are proclaiming that they will write “rules” for the ages regarding hypotheticals and not this specific case. Seriously. These men are really revolting. Hey Gorsuch: stuff your “rules”. I don’t obey you. I follow the constitution. The actual spirit of the constitution as a living document whose writers INTENDED it to respond to the majority and changing times. You are not my king.

    I really appreciated Marcus's analysis. I love knowing Roberts is uncomfortable and understands the weigh of this case. Ankush, I agree with you on Biden's lack of urgency to move on SC reform. I also think the DOJ moved to slowly on the insurrectionist case. It should have been a top priority. I also think the Media and comedians made light of this issue. This should have been taken more seriously but too many assumed justice would prevail. Does not appear to be happening.

    I hate to be a conspiracy buff but can't free myself from the thought that the trump team knew they could count on some sort of help from the supreme court. I listened to the whole proceeding and it was, at times, almost shameful. 'No-one is above the law" has been a bedrock of american law for almost 250 years, until suddenly it wasn't. Particularly the questions from Alito, but also from Gorsuch, were outrageous and cringeworthy.

    Criminal acts are not sanctioned by anyone under US laws or under International, treaties, or under the Heavens.
    Extradition issues are debatable for tribunals for human right violations and alleged war crimes that must be acknowledged and adjudicated even if it is done in absentia. Yeah, and congress could make up some more voter's protections against criminal politicians/profiteers, presidential or not, later.
    As it stands the defense has no standing, and the Supreme Court is not a legislative body, facts not fanciful ideological personal whims or hypothesis will excuse criminal behavior of someone they are indebted to, that does not appear to be bias attempts to aid the obstruction and abet the criminal defendant personally. The recusals by individual justices appointed by the criminal defendant, and personally invested in the outcome became obvious when they allowed the stay and delay, postponing adjudications.
    The question of a military tribunal for an acting Commander and Chief of our military for example "a gross dereliction of duty" let's say after an Insurrection had been initiated the failure to respond to multiple requests for assistance and deployment, intentionally delaying the release of national guards that were waiting, as thousands of deceived patriots assaulted fellow patriots.     One very important way of stopping this scenario from ever happening again, is to create a definition of "lifetime" federal appointments!
